Chapter 22

Chapter: Two men who claim something but have no proof.

باب الرَّجُلَيْنِ يَدَّعِيَانِ شَيْئًا وَلَيْسَتْ لَهُمَا بَيِّنَةٌ

English narration

Narrated by أبو هريرة الدوسي

Abu Hurairah reported the holy prophet ﷺ as saying: When two men dislike the oath or like it, lots will be cost about it. Salamah said on the authority of Mamar who said: when the two are compelled to take an oath.

النص العربي

حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ ، وَسَلَمَةُ بْنُ شَبِيبٍ ، قَالَا : حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، قَالَ أَحْمَدُ ، قَالَ : حَدَّثَنَا مَعْمَرٌ ، عَنْ هَمَّامِ بْنِ مُنَبِّهٍ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : "

إِذَا كَرِهَ الِاثْنَانِ الْيَمِينَ أَوِ اسْتَحَبَّاهَا فَلْيَسْتَهِمَا عَلَيْهَا

" ، قَالَ سَلَمَةُ : قَالَ : أَخْبَرَنَا مَعْمَرٌ ، وَقَالَ : إِذَا أُكْرِهَ الِاثْنَانِ عَلَى الْيَمِينِ " .
