Book 48: The Book of Mortgaging In Places Occupied by Settled Population

كِتَاب الرَّهْنِ

Chapter 6

(6) Chapter. If a dispute arises between the mortgagor and mortgagee, a proof is to be provided by plaintiff, otherwise the defendant has to take an oath (if he insists on denying the plaintiff’s claim).

6- بَابُ إِذَا اخْتَلَفَ الرَّاهِنُ وَالْمُرْتَهِنُ وَنَحْوُهُ فَالْبَيِّنَةُ عَلَى الْمُدَّعِي وَالْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ:

English narration

Narrated by عبد الله بن العباس القرشي

I wrote a letter to Ibn 'Abbas and he wrote to me that the Prophet (ﷺ) had given the verdict that the defendant had to take an oath.

النص العربي

حَدَّثَنَا خَلَّادُ بْنُ يَحْيَى ، حَدَّثَنَا نَافِعُ بْنُ عُمَرَ ، عَنِ ابْنِ أَبِي مُلَيْكَةَ قَالَ : كَتَبْتُ إِلَى ابْنِ عَبَّاسٍ ، "

فَكَتَبَ إِلَيَّ إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ

" .
