11 م- بَابٌ في الشُّرْبِ، وَمَنْ رَأَى صَدَقَةَ الْمَاءِ وَهِبَتَهُ وَوَصِيَّتَهُ جَائِزَةً، مَقْسُومًا كَانَ أَوْ غَيْرَ مَقْسُومٍ:(1b) Chapter. Whoever things that giving water in charity, or as a gift or by way of a testament is permissible, whether it is divided or not.22- بَابُ مَنْ قَالَ إِنَّ صَاحِبَ الْمَاءِ أَحَقُّ بِالْمَاءِ حَتَّى يَرْوَى:(2) Chapter. Whoever said, " The owner of the water has the right to drink till he is satisfied, as a Prophet ﷺ said, Superfluous water should not be withheld from others.33- بَابُ مَنْ حَفَرَ بِئْرًا فِي مِلْكِهِ لَمْ يَضْمَنْ:(3) Chapter. If one digs a well in his own land and somebody falls in it and dies, and owner is not reponsible.44- بَابُ الْخُصُومَةِ فِي الْبِئْرِ وَالْقَضَاءِ فِيهَا:(4) Chapter. Disputes and controversies about wells and the settlement of such disputes and contraversies.55- بَابُ إِثْمِ مَنْ مَنَعَ ابْنَ السَّبِيلِ مِنَ الْمَاءِ:(5) Chapter. The sin of him who withholds water from wayfarer and travellers.66- بَابُ سَكْرِ الأَنْهَارِ:(6) Chapter. The dams of rivers.77- بَابُ شُرْبِ الأَعْلَى قَبْلَ الأَسْفَلِ:(7) Chapter. The land near the source of water has the right to be irrigated before the one that is farther.88- بَابُ شِرْبِ الأَعْلَى إِلَى الْكَعْبَيْنِ:(8) Chapter. The land nearer to the source of water has the right to be covered with water up to the ankles.99- بَابُ فَضْلِ سَقْيِ الْمَاءِ:(9) Chapter. The superiority of providing water (to those who need it).1010- بَابُ مَنْ رَأَى أَنَّ صَاحِبَ الْحَوْضِ وَالْقِرْبَةِ أَحَقُّ بِمَائِهِ:(10) Chapter. Whoever thinks that the owner of a tank, or a leather water-containe has a more.1111- بَابُ لاَ حِمَى إِلاَّ لِلَّهِ وَلِرَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:(11) Chapter. No Hima (private pasture) except according to what Allah and His Messenger ﷺ did.1212- بَابُ شُرْبِ النَّاسِ وَالدَّوَابِّ مِنَ الأَنْهَارِ:(12) Chapter. Drinking water by people and watering animals from the rivers.1313- بَابُ بَيْعِ الْحَطَبِ وَالْكَلإِ:(13) Chapter. The selling of wood and grass.1414- بَابُ الْقَطَائِعِ:(14) Chapter. The uncultivated pieces of land (granted by the ruler to some individuals).1516- بَابُ حَلَبِ الإِبِلِ عَلَى الْمَاءِ:(16) Chapter. Milking she-camels at water places.1617- بَابُ الرَّجُلِ يَكُونُ لَهُ مَمَرٌّ، أَوْ شِرْبٌ فِي حَائِطٍ أَوْ فِي نَخْلٍ(17) Chapter. One may have the right to pass through a garden or to have a share in date-palms.

Bukhari · 2351أُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِقَدَحٍ ، فَشَرِبَ مِنْهُ ، وَعَنْ يَمِينِهِ غُلَامٌ أَصْغَرُ الْقَوْمِ ، وَالْأَشْيَاخُ عَنْ يَسَارِهِ ، فَقَالَ : يَا غُلَامُ ، أَتَأْذَنُ لِي أَنْ أُعْطِيَهُ الْأَشA tumbler (full of milk or water) was brought to the Prophet (ﷺ) who drank from it, while on his right side there was sitting a boy who was the youngest of those who were present and on his left side there were old men. 4 narratorsBukhari · 2352أَنَّهَا حُلِبَتْ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ شَاةٌ دَاجِنٌ وَهِيَ فِي دَارِ أَنَسِ بْنِ مَالِكٍ ، وَشِيبَ لَبَنُهَا بِمَاءٍ مِنَ الْبِئْرِ الَّتِي فِي دَارِ أَنَسٍ ، فَأَعْطَى رَسُولَ اللَّهِ صَلAnas bin Malik said, that once a domestic sheep was milked for Allah's Messenger (ﷺ) while he was in the house of Anas bin Malik. The milk was mixed with water drawn from the well in Anas's house. A tumbler of it was pre4 narratorsBukhari · 2353لَا يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلَأُAllah's Messenger (ﷺ) said, "Do not withhold the superfluous water, for that will prevent people from grazing their cattle."5 narratorsBukhari · 2354لَا تَمْنَعُوا فَضْلَ الْمَاءِ لِتَمْنَعُوا بِهِ فَضْلَ الْكَلَإِthat Allah's Messenger (ﷺ) said, "Do not withhold the superfluous water in order to withhold the superfluous grass."6 narratorsBukhari · 2355الْمَعْدِنُ جُبَارٌ ، وَالْبِئْرُ جُبَارٌ ، وَالْعَجْمَاءُ جُبَارٌ ، وَفِي الرِّكَازِ الْخُمْسُAllah's Messenger (ﷺ) said, "No bloodmoney will be charged if somebody dies in a mine or in a well or is killed by an animal; and if somebody finds a treasure in his land he has to give one-fifth of it to the Government.6 narratorsBukhari · 2356مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ هُوَ عَلَيْهَا فَاجِرٌ ، لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ ، فَأَنْزَلَ اللَّهُ تَعَالَى : إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِThe Prophet (ﷺ) said, "Whoever takes a false oath to deprive somebody of his property will meet Allah while He will be angry with him." Allah revealed 'Verily those who purchase a little gain at the cost of Allah's coven6 narratorsBukhari · 2357مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ هُوَ عَلَيْهَا فَاجِرٌ ، لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ ، فَأَنْزَلَ اللَّهُ تَعَالَى : إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِThe Prophet (ﷺ) said, "Whoever takes a false oath to deprive somebody of his property will meet Allah while He will be angry with him." Allah revealed 'Verily those who purchase a little gain at the cost of Allah's coven6 narratorsBukhari · 2358ثَلَاثَةٌ لَا يَنْظُرُ اللَّهُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ : رَجُلٌ كَانَ لَهُ فَضْلُ مَاءٍ بِالطَّرِيقِ فَمَنَعَهُ مِنَ ابْنِ السَّبِيلِ ، وَرَجُلٌ بَايَعَ إِمَامًا لَا يُبAllah's Messenger (ﷺ) said, "There are three persons whom Allah will not look at on the Day of Resurrection, nor will he purify them and theirs shall be a severe punishment. They are -1. A man possessed superfluous water5 narratorsBukhari · 2359أَنَّ رَجُلًا مِنْ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ ، فَقَالَ الْأَنْصَارِيُّ : سَرِّحْ الْمَاءَ يَمُرُّ ، فَأَAn Ansari man quarreled with Az-Zubair in the presence of the Prophet (ﷺ) about the Harra Canals which were used for irrigating the date-palms. The Ansari man said to Az-Zubair, "Let the water pass' but Az-Zubair refused5 narratorsBukhari · 2360أَنَّ رَجُلًا مِنْ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ ، فَقَالَ الْأَنْصَارِيُّ : سَرِّحْ الْمَاءَ يَمُرُّ ، فَأَAn Ansari man quarreled with Az-Zubair in the presence of the Prophet (ﷺ) about the Harra Canals which were used for irrigating the date-palms. The Ansari man said to Az-Zubair, "Let the water pass' but Az-Zubair refused5 narratorsBukhari · 2361خَاصَمَ الزُّبَيْرَ رَجُلٌ مِنْ الْأَنْصَارِ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : يَا زُبَيْرُ ، اسْقِ ، ثُمَّ أَرْسِلْ ، فَقَالَ الْأَنْصَارِيُّ : إِنَّهُ ابْنُ عَمَّتِكَ ، فَقَالَ عَلَيْهِ السَّلَامWhen a man from the Ansar quarreled with Az-Zubair, the Prophet (ﷺ) said, "O Zubair! Irrigate (your land) first and then let the water flow (to the land of the others)." "On that the Ansari said, (to the Prophet), "It is5 narratorsBukhari · 2362أَنَّ رَجُلًا مِنْ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ فِي شِرَاجٍ مِنَ الْحَرَّةِ يَسْقِي بِهَا النَّخْلَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : اسْقِ يَا زُبَيْرُ ، فَأَمَرَهُ بِالْمَعْرُوفِ ، ثُمَّAn Ansari man quarreled with Az-Zubair about a canal in the Harra which was used for irrigating date-palms.
